Please read these Terms and Conditions carefully before placing an order with us. By purchasing from www.jparsonage.com, you agree to be bound by these Terms. If you do not agree, please do not place an order.

 

These Terms and Conditions apply to all sales of prints, etchings, and related works made through our website. They are governed by the laws of England and Wales and comply with the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and all other applicable UK consumer protection legislation.

J. Parsonage is a sole trader dealing in original prints, etchings, and works on paper. References to "we", "us", or "our" in these Terms refer to J. Parsonage. References to "you" or "your" refer to the customer purchasing from our website.

 

 

2. THESE TERMS

2.1 These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between us in relation to your purchase. No other terms apply unless agreed in writing.

 

2.2 We reserve the right to update these Terms from time to time. The Terms in force at the time you place your order will apply to your purchase. We will notify you of any material changes by updating this page.

 

2.3 If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

 

 

3. THE WORKS WE SELL

3.1 We specialise in original prints and etchings. Works may include, but are not limited to: etchings, lithographs, screen prints, woodblock prints, linocuts, mezzotints, aquatints, and giclΓ©e prints. Each listing will specify the type of work.

 

3.2 Where a work is described as an "original print", this means it has been produced by a hand-process from a matrix (plate, block, stone, or screen) under the supervision of or by the artist, and is typically numbered and signed. It is not a photographic reproduction of a painting or drawing.

 

3.3 Where a work is described as a "giclΓ©e print" or "reproduction print", this will be clearly stated in the listing. Such works are high-quality digital reproductions and are priced accordingly.

 

3.4 Edition information (e.g. 3/25) will be stated in the listing where known. Works described as "unique" are one-of-a-kind impressions.

 

3.5 All dimensions given in our listings are approximate and refer to the image size unless otherwise stated. Frame dimensions, where given, are also approximate. Dimensions are stated in centimetres (height Γ— width) unless otherwise specified.

 

3.6 We make every effort to represent colours accurately in our photography, but please be aware that colours may appear differently depending on your screen's calibration, resolution, and settings. If accurate colour matching is important to you, please contact us before purchasing.

 

 

4. CONDITION & DESCRIPTIONS

4.1 All works are described as accurately and honestly as possible. Condition is described using the following terminology:

 

Excellent - No faults; the work is in pristine or near-pristine condition.

Very Good - Minor signs of age or handling not detrimental to the work.

Good - Some age-related characteristics such as toning, light foxing, or minor handling marks; clearly disclosed.

Fair - More significant condition issues; disclosed in full in the listing.

 

4.2 We strongly encourage you to read the full condition description and to request additional photographs or a written condition report before purchasing, particularly for works in Good or Fair condition.

 

4.3 For works described as antique or vintage, evidence of age is to be expected and does not constitute a fault. Such characteristics will be disclosed in the listing.

 

4.4 We warrant that every description we provide is accurate to the best of our knowledge and belief at the time of listing. If we become aware of any inaccuracy, we will amend the listing and notify any prospective buyer who has made an enquiry.

 

4.5 If a work arrives and is materially different from its description β€” beyond normal variations in colour rendering on different screens β€” please contact us immediately. Your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms.

 

 

5. ATTRIBUTION & AUTHENTICITY

5.1 Where a work is attributed to a named artist, we warrant that we have reasonable grounds to believe that attribution to be correct, based on the evidence available to us at the time of sale. We will disclose the basis for attribution in the listing or on request.

 

5.2 Where we are uncertain of attribution, works will be described using qualified language such as "attributed to", "circle of", "after", or "in the manner of", in accordance with standard art trade practice.

 

5.3 Any opinion on attribution or authenticity is given in good faith and represents our honest assessment. It is not a guarantee of authorship. If you require a formal authentication from an independent expert, catalogue raisonnΓ© committee, or technical analyst, we recommend you arrange this before completing your purchase.

 

5.4 We do not knowingly deal in works that are forgeries, misattributed, or subject to unresolved ownership disputes. Should any such issue come to light after sale, please contact us immediately.

 

 

6. PROVENANCE

6.1 Where provenance information is available, it will be included in the listing or provided on request.

 

6.2 We warrant that, to the best of our knowledge, each work we sell is free from any claim, encumbrance, or restriction on title at the time of sale.

 

6.3 We check works against the Art Loss Register prior to offering them for sale. Details of checks carried out are available on request.

 

6.4 If after purchase a third-party claim to title is established, we will work with you in good faith to resolve the matter, including by providing a full refund if required.

 

 

7. PRICING

────────────────────────────────────────────────────────────────────────

 

7.1 All prices are displayed in pounds sterling (Β£) and are inclusive of any applicable VAT where stated.

 

7.2 Delivery charges are not included in the displayed price unless explicitly stated. Delivery costs will be clearly shown at checkout before you complete your purchase.

 

7.3 We reserve the right to change prices at any time. Price changes will not affect orders already accepted.

 

7.4 In the event of a pricing error on our website, we are not obliged to sell a work at the incorrect price. We will notify you as soon as possible and give you the option to purchase at the correct price or cancel your order with a full refund.

 

 

8. HOW TO PLACE AN ORDER

8.1 By placing an order through our website, you are making an offer to purchase the relevant work subject to these Terms.

 

8.2 We will send you an order acknowledgement by email promptly after you place your order. This acknowledgement confirms receipt of your order but does not constitute our acceptance of it.

 

8.3 A binding contract between us is formed only when we send you a separate order confirmation email stating that your order has been accepted and the work is reserved for you.

 

8.4 We reserve the right to decline any order at our discretion, for example where a work has been sold to another buyer, where we suspect fraudulent activity, or where we are unable to verify your payment. In such cases, any payment taken will be refunded in full.

 

8.5 As each work is unique or produced in limited editions, we cannot guarantee availability. If a work you have ordered is no longer available, we will notify you immediately and offer a full refund.

 

 

9. PAYMENT

9.1 Payment is required in full at the time of placing your order, unless otherwise agreed in writing.

 

9.2 We accept payment by the methods shown at checkout, which may include major credit and debit cards and other secure payment services. Payment is processed by our third-party payment provider and is subject to their terms.

 

9.3 We do not store your full payment card details. All payment data is handled securely and in accordance with our Privacy Policy.

 

9.4 For higher-value purchases, we may offer instalment arrangements at our discretion. Any such arrangement must be agreed in writing before the order is placed. Title to the work will not pass until all instalments have been received in full.

 

9.5 Works will not be dispatched until payment has been received and cleared in full.

 

 

10. ARTIST'S RESALE RIGHT (ARR)

10.1 The Artist's Resale Right Regulations 2006 may apply to the resale of qualifying works by living artists, or artists who died within the last 70 years, where the sale price exceeds Β£1,000.

 

10.2 Where ARR applies, a royalty calculated on a sliding scale is payable to the artist or their estate. We will notify you if ARR applies to your purchase and will administer the royalty payment through DACS (Design and Artists Copyright Society) on your behalf.

 

10.3 ARR is a statutory right and cannot be waived or transferred. It is not negotiable and is not included in or deducted from the sale price β€” it is an additional sum payable by the buyer.

 

 

11. COPYRIGHT

11.1 The sale of a physical print or etching does not transfer copyright in the image. Copyright in the work remains with the artist or their estate unless explicitly assigned in writing.

 

11.2 You may not reproduce, publish, broadcast, or make commercial use of images of any work purchased from us without obtaining the appropriate licence from the copyright holder.

 

11.3 We grant you a limited, non-exclusive, personal licence to photograph the work you have purchased for private, non-commercial purposes, including sharing on personal social media accounts, provided that J. Parsonage and the artist are credited where possible.

 

11.4 All images of works on our website are our property or are used with permission. You may not reproduce, download, or use these images without our prior written consent.

 

 

12. DELIVERY

────────────────────────────────────────────────────────────────────────

 

12.1 We take great care in packing works for despatch. Prints and etchings are packaged using acid-free tissue, rigid backing boards, and protective outer packaging appropriate to the size and value of the work.

 

12.2 We aim to dispatch orders within 5 working days of receiving cleared payment, unless otherwise stated in the listing or agreed with you.

 

12.3 Estimated delivery times will be provided at checkout. These are estimates only and we cannot guarantee delivery by a specific date, particularly for international orders.

 

12.4 We will provide you with tracking information where available once your order has been dispatched.

 

12.5 Risk in the work passes to you on delivery to your specified delivery address. We strongly recommend that you inspect the work promptly upon receipt.

 

12.6 If you are not available to accept delivery, please follow the instructions of the delivery provider. We are not responsible for works that are left in an unsecured location at your direction.

 

12.7 For international orders, you are responsible for any import duties, taxes, or customs charges applicable in your country. We cannot predict these charges and recommend you check with your local customs authority before ordering.

 

12.8 We do not accept responsibility for delays caused by events outside our reasonable control, including strikes, severe weather, customs delays, or carrier disruption.

 

12.9 If a work is damaged in transit, please retain all original packaging and contact us at james@jparsonage.com within 48 hours of delivery with photographs of the damage. Failure to retain packaging may affect any claim with the carrier.

 

 

13. TITLE

────────────────────────────────────────────────────────────────────────

 

13.1 Legal title to a work passes to you only upon our receipt of payment in full, including any delivery charges.

 

13.2 Until title passes, the work remains our property. If payment is not received or is reversed, we reserve the right to reclaim the work.

 

 

14. RETURNS & CANCELLATIONS

14.1 Your Statutory Right to Cancel (14 Days)

 

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of receiving the work, without giving any reason. This is your statutory minimum right.

 

14.2 Our Extended Returns Policy (30 Days)

 

In addition to your statutory rights, we offer an extended returns period of 30 days from the date you receive the work. You may return any work within 30 days of receipt, provided the conditions set out in clause 14.4 are met.

 

14.3 How to Notify Us of a Return

 

To exercise your right to return, you must notify us in writing within the 30-day period by emailing james@jparsonage.com with:

 

β€’ Your name and order reference number

β€’ The title and description of the work you wish to return

β€’ The reason for the return (optional, but helpful to us)

 

We will respond within 2 working days with return instructions.

 

14.4 Condition of Returned Works

 

To be eligible for a return and refund, the work must be:

 

β€’ In the same condition as when it was delivered to you β€” unframed works must not have been framed; works must be free from any new damage, marks, or alterations

β€’ Returned with all original documentation provided (certificate of authenticity, condition report, provenance documentation, invoice)

β€’ Packaged securely, using materials appropriate to protect the work during return transit

 

We reserve the right to refuse a return or to make a reasonable deduction from your refund if the work has been damaged, altered, or is returned without its original documentation.

 

14.5 Return Postage

 

You are responsible for the cost of return postage unless the work is being returned because it is faulty, materially misdescribed, or not as ordered (see clause 14.7).

 

We strongly recommend that you use a tracked, insured, specialist art courier service for return shipments. We cannot accept responsibility for works lost or damaged in return transit. Risk in the work remains with you until we have received and inspected it.

 

14.6 Refunds

 

Upon receipt and inspection of the returned work, we will process your refund within 14 days. Refunds will be made to the original payment method used.

 

We will refund the full purchase price of the work. Original delivery charges will be refunded where you are exercising your statutory 14-day right to cancel; original delivery charges are not refundable for returns made between day 15 and day 30 of our extended policy, unless the return is due to fault or misdescription.

 

14.7 Faulty, Damaged, or Misdescribed Works

 

If a work arrives damaged in transit, is materially different from its description, or is not as ordered, your rights under the Consumer Rights Act 2015 apply in full. In such cases:

 

β€’ Please contact us at james@jparsonage.com within 48 hours of delivery with photographs

β€’ We will offer a full refund including all delivery and return postage costs, or a replacement where one is available

β€’ You do not need to return the work at your own expense

 

14.8 Works Not Eligible for Return

 

The following are not eligible for return under this policy:

 

β€’ Works that have been framed or mounted by you after purchase

β€’ Works that have been damaged by you after delivery

β€’ Bespoke, commissioned, or personalised works made to your specification

β€’ Works sold at a clearly marked final sale price, where this was agreed in writing before purchase

 

14.9 Your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 are not affected by these Terms.

 

 

15. OUR LIABILITY

────────────────────────────────────────────────────────────────────────

 

15.1 We are responsible to you for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. We are not responsible for loss or damage that is not foreseeable.

 

15.2 We do not limit or exclude our liability for:

β€’ Death or personal injury caused by our negligence

β€’ Fraud or fraudulent misrepresentation

β€’ Any liability that cannot be excluded or limited under applicable law, including your rights under the Consumer Rights Act 2015

 

15.3 We are not liable for business losses. Our works are sold for private, domestic use. If you use a work for any commercial purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

 

15.4 We are not liable for any loss or damage arising from: the subjective assessment of artistic merit or value; fluctuations in market value of works after purchase; or changes in attribution or scholarly opinion after sale, provided our original description was accurate to the best of our knowledge at the time.

 

 

16. ENQUIRIES & RESERVATIONS

16.1 We are happy to reserve a work for up to 48 hours while you consider a purchase. Please contact us at james@jparsonage.com to request a reservation.

 

16.2 A reservation does not constitute a binding agreement. The work will be released for general sale if we do not receive your order within the agreed reservation period.

 

16.3 We welcome enquiries about any work listed. We can provide additional photographs, condition reports, provenance details, and framing recommendations on request.

 

 

17. COMPLAINTS

────────────────────────────────────────────────────────────────────────

 

17.1 If you are unhappy with any aspect of your purchase or our service, please contact us in the first instance at james@jparsonage.com. We aim to respond to all complaints within 5 working days and to resolve matters promptly and fairly.

 

17.2 If we are unable to resolve your complaint to your satisfaction, you may wish to use an alternative dispute resolution (ADR) scheme. Details of ADR providers approved under the Alternative Dispute Resolution for Consumer Disputes Regulations 2015 can be found at: https://www.gov.uk/find-an-ombudsman

 

17.3 The European Commission's Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr β€” this may be relevant if you are purchasing from the EU.

 

 

18. GENERAL

18.1 These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or your purchase will be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer resident in Scotland, Northern Ireland, or the EU, in which case you may bring proceedings in the courts of your place of residence.

 

18.2 We may transfer our rights and obligations under these Terms to another organisation, for example in the event of a business sale or transfer. We will notify you in writing if this happens. Your rights under these Terms will not be affected.

 

18.3 If we do not insist on strict performance of any obligation under these Terms, or if we delay in exercising any right, that shall not mean that we have waived those rights or that you are relieved of your obligations.

 

18.4 These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 for any third party to enforce any term of these Terms.

 

18.5 Nothing in these Terms affects your statutory rights as a consumer.
